Terms of Service

These Terms of Service ("Terms") govern your use of Oddscouter, including the website at https://www.oddscouter.com and all related software and services (the "Service"). The Service is operated by Zachary Jones ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. What the Service is, and isn't

Oddscouter is informational software. It collects odds that sportsbooks publish, calculates analytics such as estimated fair odds, expected value and line movement, and lets you save filters, keep watchlists, record bets you place elsewhere, and take part in a community forum.

Oddscouter is not a sportsbook, casino, exchange or gambling operator. We do not accept wagers, hold or transfer funds for betting, offer prizes, or place bets for you. We are not affiliated with, endorsed by, or sponsored by any sportsbook. Sportsbook names are used only to identify where odds come from.

Nothing in the Service is betting, financial, legal or tax advice, or a recommendation to place any bet. Analytics are estimates. Positive expected value does not mean a bet will win, and past results do not predict future results. You alone are responsible for your betting decisions and their outcomes.

2. Eligibility

You must be at least 21 years old, and old enough to bet legally where you live, to use the Service. You may use the Service only where doing so is lawful, and you are responsible for knowing and following the laws that apply to you. The Service is not offered in Japan. We may refuse or end service anywhere we believe it would be unlawful or inappropriate.

3. Accounts

You must give a valid email address and keep your password confidential. One account is for one person. Don't share your login or let others use your account. You're responsible for activity under your account; tell us promptly at 2zacharyjones2@gmail.com if you think it has been compromised.

4. Subscriptions, free trials and automatic renewal

Some features require a paid subscription. The current plan is Oddscouter Pro: 7-day free trial, then $29 per month. Renews automatically every month until you cancel. Cancel anytime from your account; you keep access until the end of the period you've paid for. No partial-month refunds.

• Automatic renewal. Your subscription renews automatically at the end of each billing period, and we charge the payment method on file the then-current price, until you cancel.
• Free trial. If a free trial is offered, you'll be asked for a payment method at sign-up. Unless you cancel before the trial ends, your paid subscription starts automatically at the end of the trial and you will be charged. Free trials are limited to one per person and one per payment card. If you start a trial with a card that has already been used for a trial, the trial is skipped and your paid subscription starts immediately, as stated at checkout.
• Cancel anytime. You can cancel online at any time from your account (Account → Manage billing). Cancellation takes effect at the end of the current billing period; you keep access until then and will not be charged again.
• Refunds. Fees are non-refundable, and we don't give refunds or credits for partial billing periods, except where required by law. See the Refund & Cancellation Policy.
• Failed payments. If a renewal payment fails, we may retry it and may suspend paid features until payment succeeds.
• Price changes. We may change prices for future billing periods. We'll tell you by email at least 30 days before a price increase applies to you, and you can cancel before it takes effect.
• Payments. Payments are processed by Stripe. We don't receive or store your full card number. Applicable taxes may be added.

5. Acceptable use

You agree not to:

• copy, scrape, crawl, resell, redistribute or publish data from the Service, or use it to build a competing product;
• share your account, or access the Service by automated means except through features we provide;
• probe, attack, overload or interfere with the Service, or try to get around its security or access controls;
• reverse engineer the Service except where the law allows it despite this restriction;
• use the Service for anything unlawful, including betting where it is not permitted for you; or
• harass others, post spam, advertise ("touting" picks for money), impersonate anyone, or post content that is unlawful, infringing, hateful or obscene.

6. Your content

You keep ownership of what you post in the forum or store in your account (such as notes and tracked bets). You give us a worldwide, non-exclusive, royalty-free license to host, display and process that content as needed to run the Service. Forum posts are visible to other members. We may remove content or restrict forum access at our discretion, including for violating these Terms. Your private data, such as your watchlists and tracked bets, is never shown to other users, though we may display anonymous totals (for example, how many users are watching a bet).

7. Our property

The Service, including its software, design, analytics and compiled data, belongs to us or our licensors. We give you a limited, personal, non-transferable, revocable right to use the Service for your own non-commercial purposes while your account is in good standing.

8. Data accuracy and availability

Odds come from third parties and change constantly. Data may be delayed, incomplete or wrong, and features may change. We don't promise that the Service will be uninterrupted, error-free or available at any particular time. Always confirm prices with the sportsbook before placing a bet.

9. Suspension and termination

You can close your account at any time by contacting us. We may suspend or terminate your account if you break these Terms, if required by law, or to protect the Service or other users. If we terminate your paid subscription without cause, we'll refund the unused part of your current billing period.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY BETTING LOSSES, LOST PROFITS OR LOST DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions don't allow some of these limits, so they may not apply to you.

12. Indemnity

You agree to defend and hold us harmless from claims and costs arising from your misuse of the Service or your breach of these Terms.

13. Governing law

These Terms are governed by the laws of the State of NJ and applicable US federal law, without regard to conflict-of-law rules. Nothing here limits rights you have under consumer-protection laws that can't be waived.

14. Changes to these Terms

We may update these Terms. If a change is material, we'll notify you by email or in the Service before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
